전기통신사업법 제75조(장해물등의 제거 요구)

① 기간통신사업자는 선로등의 설치 또는 전기통신설비에 장해를 주거나 줄 우려가 있는 가스관ㆍ수도관ㆍ하수도관ㆍ전등선ㆍ전력선 또는 자가전기통신설비(이하 "장해물등"이라 한다)의 소유자나 점유자에게 그 장해물등의 이전ㆍ개조ㆍ수리 또는 그 밖의 조치를 요구할 수 있다.

② 기간통신사업자는 식물이 선로등의 설치ㆍ유지 또는 전기통신에 장해를 주거나 줄 우려가 있으면 그 소유자나 점유자에게 식물의 제거를 요구할 수 있다.

③ 기간통신사업자는 식물의 소유자나 점유자가 제2항에 따른 요구에 따르지 아니하거나 그 밖의 부득이한 사유가 있는 경우에는 과학기술정보통신부장관의 허가를 받아 그 식물을 벌채하거나 이식할 수 있다. 이 경우 해당 식물의 소유자나 점유자에게 지체 없이 그 사실을 알려야 한다. <개정 2013.3.23, 2017.7.26>

④ 기간통신사업자의 전기통신설비에 장해를 주거나 줄 우려가 있는 장해물등의 소유자나 점유자는 그 장해물등을 신설ㆍ증설ㆍ개선ㆍ철거 또는 변경할 필요가 있으면 미리 기간통신사업자와 협의하여야 한다. <개정 2020.6.9>
