전기통신사업법 제73조(토지등의 일시 사용)

① 기간통신사업자는 선로등에 관한 측량, 전기통신설비의 설치공사 또는 보전공사를 하기 위하여 필요한 경우에는 현재의 사용을 뚜렷하게 방해하지 아니하는 범위에서 사유 또는 국유ㆍ공유의 전기통신설비 및 토지등을 일시 사용할 수 있다.

② 누구든지 제1항에 따른 선로등의 측량, 전기통신설비의 설치공사 또는 보전공사와 이를 위한 전기통신설비 및 토지등의 일시 사용을 정당한 사유 없이 방해하여서는 아니 된다.

③ 기간통신사업자는 제1항에 따라 사유 또는 국유ㆍ공유 재산을 일시 사용하려면 미리 점유자에게 사용목적과 사용기간을 알려야 한다. 다만, 미리 알리는 것이 곤란한 경우에는 사용을 할 때 또는 사용 후 지체 없이 알리고, 점유자의 주소나 거소를 알 수 없어 사용목적과 사용기간을 알릴 수 없는 경우에는 이를 공고하여야 한다.

④ 제1항에 따른 토지등의 일시 사용기간은 6개월을 초과할 수 없다.

⑤ 제1항에 따라 사유 또는 국유ㆍ공유의 전기통신설비나 토지등을 일시 사용하는 사람은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다.
