재난 및 안전관리 기본법 제59조(재난복구계획의 수립ㆍ시행)

① 재난관리책임기관의 장은 사회재난으로 인한 피해[사회재난 중 제60조제4항에 따라 특별재난지역으로 선포된 지역의 사회재난으로 인한 피해(이하 이 조에서 "특별재난지역 피해"라 한다)는 제외한다]에 대하여 제58조제2항에 따른 피해조사를 마치면 지체 없이 자체복구계획을 수립ㆍ시행하여야 한다. <개정 2024.1.16, 2025.4.1>

② 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 특별재난지역 피해에 대하여 관할구역의 피해상황을 종합하는 재난복구계획을 수립한 후 수습본부장 및 관계 중앙행정기관의 장과 협의를 거쳐 중앙대책본부장에게 제출하여야 한다.

③ 제2항에도 불구하고 긴급하게 복구를 실시하여야 하는 등 대통령령으로 정하는 특별한 사유가 있는 경우에는 수습본부장이 특별재난지역 피해에 대한 재난복구계획을 직접 수립하여 중앙대책본부장에게 제출할 수 있다.

④ 중앙대책본부장은 제2항 또는 제3항에 따라 제출받은 재난복구계획을 제14조제3항 본문에 따른 중앙재난안전대책본부회의의 심의를 거쳐 확정하고, 이를 관계 재난관리책임기관의 장에게 통보하여야 한다.

⑤ 재난관리책임기관의 장은 제4항에 따라 재난복구계획을 통보받으면 그 재난복구계획에 따라 지체 없이 재난복구를 시행하여야 한다. 이 경우 지방자치단체의 장은 재난복구를 위하여 필요한 경비를 지방자치단체의 예산에 계상(計上)하여야 한다.
