재난 및 안전관리 기본법 제45조(응급부담)

시장ㆍ군수ㆍ구청장과 지역통제단장(대통령령으로 정하는 권한을 행사하는 경우에만 해당한다)은 그 관할 구역에서 재난이 발생하거나 발생할 우려가 있어 응급조치를 하여야 할 급박한 사정이 있으면 해당 재난현장에 있는 사람이나 인근에 거주하는 사람에게 응급조치에 종사하게 하거나 대통령령으로 정하는 바에 따라 다른 사람의 토지ㆍ건축물ㆍ인공구조물, 그 밖의 소유물을 일시 사용할 수 있으며, 장애물을 변경하거나 제거할 수 있다.
