자원의 절약과 재활용촉진에 관한 법률 시행규칙 제10조(폐기물부담금ㆍ재활용부과금의 반환)

① 폐기물부담금 또는 법 제19조제1항에 따른 재활용부과금(이하 "재활용부과금"이라 한다)을 납부한 자가 영 제14조제1항에 따라 폐기물부담금 또는 재활용부과금을 반환받으려는 경우에는 별지 제5호서식의 폐기물부담금ㆍ재활용부과금 반환청구서에 다음 각 호의 서류를 첨부하여 공단에 제출해야 한다. 다만, 공단이 법 제34조의7제2항에 따른 자원 절약 및 재활용촉진 정보시스템을 통하여 첨부서류에 대한 정보를 확인할 수 있는 경우에는 그 확인으로 해당 서류의 제출을 갈음할 수 있다.

② 제1항에 따른 청구를 받은 공단은 그 내용을 확인한 후 별지 제6호서식의 폐기물부담금ㆍ재활용부과금 반환지급 결정서를 청구인에게 발급해야 한다.
