자본시장과 금융투자업에 관한 법률 제169조(회계감사인에 의한 감사증명)

① 이 편에 따라 금융위원회와 거래소에 재무에 관한 서류를 제출하는 자 중 대통령령으로 정하는 자는 「주식회사 등의 외부감사에 관한 법률」에 따라 회계감사를 받아야 한다. 다만, 기업경영 등 비밀유지 및 기업부담과 투자자 보호와의 형평 등을 고려하여 대통령령으로 정하는 사항에 대하여는 그러하지 아니하다. <개정 2008.2.29, 2017.10.31>

② 금융위원회는 투자자 보호를 위하여 필요하다고 인정되는 경우에는 제1항에 따라 회계감사를 한 회계감사인 또는 회계감사를 받은 법인에 대하여 자료의 제출 및 보고를 명하거나, 그 밖에 필요한 조치를 할 수 있다. <개정 2008.2.29>

③ 외국법인등이 외국 금융투자업관련 법령에 따라 회계감사를 받은 경우로서 대통령령으로 정하는 기준을 충족하였을 경우에는 제1항 본문에 따른 회계감사를 받은 것으로 본다. 이 경우 제2항은 외국 금융투자업관련 법령에 따라 회계감사를 한 회계감사인(이하 "외국회계감사인"이라 한다) 또는 회계감사를 받은 외국법인등에게 준용한다.
