자동차손해배상 보장법 제5조의2(보험 등의 가입 의무 면제)

① 자동차보유자는 보유한 자동차(제5조제3항 각 호의 자가 면허 등을 받은 사업에 사용하는 자동차는 제외한다)를 해외체류 등으로 3개월 이상 2년 이하의 범위에서 일정 기간 운행할 수 없는 경우로서 대통령령으로 정하는 경우에는 그 자동차의 등록업무를 관할하는 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사(자동차의 등록업무가 시장ㆍ군수ㆍ구청장에게 위임된 경우에는 시장ㆍ군수ㆍ구청장을 말한다. 이하 "시ㆍ도지사"라 한다)의 승인을 받아 그 운행중지기간에 한정하여 제5조제1항 및 제2항에 따른 보험 또는 공제에의 가입 의무를 면제받을 수 있다. 이 경우 자동차보유자는 해당 자동차등록증 및 자동차등록번호판을 시ㆍ도지사에게 보관하여야 한다. <개정 2020.6.9, 2021.7.27, 2024.1.16>

② 제1항에 따라 보험 또는 공제에의 가입 의무를 면제받은 자는 면제기간 중에는 해당 자동차를 도로에서 운행하여서는 아니 된다.

③ 보험회사등은 자기와 제1항에 따라 보험 또는 공제에의 가입 의무를 면제받은 자가 체결한 보험 또는 공제의 계약기간을 국토교통부령으로 정하는 바에 따라 그 운행중지기간 내에서 유예할 수 있다. <신설 2024.1.16>
