자동차관리법 제34조의6(업데이트의 적정성 조사 등)

① 국토교통부장관은 업데이트의 안전성 확보를 위하여 필요하다고 인정하는 경우에는 성능시험대행자에게 업데이트의 내용과 방법 및 관리실태의 적정성에 관한 조사를 하게 할 수 있다. 이 경우 국토교통부장관은 조사에 드는 비용을 출연하거나 지원하여야 한다.

② 성능시험대행자는 제1항에 따른 조사를 실시하는 경우 조사를 받는 자의 업데이트와 관련된 시설, 장비, 자동차, 장부, 서류 또는 그 밖의 물건을 검사하거나 관계인에게 질문할 수 있다.

③ 제1항에 따른 조사의 절차 등에 관하여는 제72조제3항 및 제4항을 준용한다. 이 때 "검사"는 "조사"로, "공무원"은 "성능시험대행자"로 본다.

④ 국토교통부장관은 제1항에 따른 조사 결과 등에 따라 업데이트가 적정하게 이루어지지 아니하였거나 그러할 우려가 있다고 인정하는 경우 해당 업데이트를 하였거나 하려는 자에게 국토교통부령으로 정하는 바에 따라 시정을 명할 수 있다.

⑤ 제4항에 따른 시정명령을 받은 자는 국토교통부령으로 정하는 바에 따라 시정조치 계획과 진행 상황을 국토교통부장관에게 보고하여야 한다.
