의무경찰대 설치 및 운영에 관한 법률 시행령 제61조(고발절차 등)

① 법 제11조제3항에 따른 지휘관은 의무경찰대장과 그 밖에 의무경찰이 배치된 경찰기관의 장(주무과장을 포함한다)을 말한다. <개정 2015.11.20>

② 지휘관이 법 제11조제2항에 따라 법 제9조 또는 제10조를 위반한 소속 의무경찰을 고발하려는 경우에는 별지 제8호서식의 고발장을 관할 경찰서에 제출하여야 한다. <개정 2015.11.20>

③ 제2항에 따른 고발은 취소하지 못한다.

④ 소속기관등의 장이 아닌 지휘관이 제2항에 따라 의무경찰을 고발하였을 때에는 지체 없이 그 의무경찰이 소속된 소속기관등의 장에게 보고하여야 한다. <개정 2015.11.20>

⑤ 지휘관은 법 제9조 또는 제10조를 위반한 사람이 발생하였을 때에는 위반 동기, 뉘우치는 정도, 평소의 성품과 행실, 근무실적 등을 종합적으로 고려하여 신중하게 고발 여부를 결정하여야 한다. 다만, 법 제9조제1항 단서, 같은 조 제2항 및 제5항, 법 제10조제2항ㆍ제6항ㆍ제7항 또는 「형법」 제129조부터 제133조까지의 규정을 위반한 경우에는 반드시 고발하여야 한다.
