Enforcement Decree of the Nuclear Safety Act, Article 82-3 (Appointment, etc. of Radiation Safety Managers)
① 허가사용자 및 신고사용자는 법 제53조의3제1항에 따라 사업소마다 방사선안전관리자를 선임하여야 하며, 선임한 방사선안전관리자를 변경하거나 해임한 때에는 지체 없이 새로운 방사선안전관리자를 선임하여야 한다. <개정 2023.3.7>
(1) Permitted users and reporting users shall appoint a radiation safety manager for each business site under Article 53-3 (1) of the Act, and when changing or dismissing an appointed radiation safety manager, shall appoint a new radiation safety manager without delay.
② 제1항에도 불구하고 법 제53조제1항 단서에 따라 방사성동위원소등을 사업소 외에서 방사선투과검사를 목적으로 이동사용하기 위한 작업장(이하 "작업장"이라 한다) 개설 또는 변경 신고를 한 자는 작업장마다 각각 제1항에 따른 방사선안전관리자를 선임하여야 한다. 다만, 작업장이 다음 각 호의 어느 하나에 해당하는 경우에는 작업장마다 방사선안전관리자를 선임하지 아니하고 해당 각 호의 구분에 따라 방사선안전관리자를 선임할 수 있다.
(2) Notwithstanding paragraph (1), a person who has reported the opening or change of a workplace (hereinafter referred to as a "workplace") for mobile use of radioisotopes, etc. outside a business site for radiographic testing under the proviso of Article 53 (1) of the Act shall appoint a radiation safety manager under paragraph (1) for each workplace. In such cases, where the workplace falls under any of the following, the person may appoint a radiation safety manager as follows, according to the relevant subparagraph, rather than appointing one for each workplace:
1. 작업장이 같은 시ㆍ군ㆍ구(자치구를 말한다. 이하 같다)에 위치하거나 그 시ㆍ군ㆍ구 경계에서 15킬로미터 이내에 위치하는 경우: 2개 이하(전용 방사선 사용시설에서만 방사선원을 사용하는 경우에는 3개 이하)의 작업장마다 1명의 방사선안전관리자
1. Where workplaces are located in the same Si/Gun/Gu (referring to an autonomous Gu; the same applies hereinafter) or within 15 kilometers of the boundary of that Si/Gun/Gu: one radiation safety manager for every two or fewer workplaces (three or fewer where radiation sources are used only in dedicated radiation use facilities); and
2. 작업장이 방사선원을 1개만 사용하고, 방사선 작업기간이 1개월 미만이며, 방사선안전관리자가 방사선 작업에 항상 참여하는 경우: 5개 이하의 작업장마다 1명의 방사선안전관리자
2. Where the workplace uses only one radiation source, the radiation work period is less than one month, and the radiation safety manager always participates in radiation work: one radiation safety manager for every five or fewer workplaces.
③ 법 제53조의3제1항 및 제3항에 따라 방사선안전관리자를 선임하거나, 선임한 방사선안전관리자를 변경 또는 해임 후 선임하는 때에는 다음 각 호의 기한까지 총리령으로 정하는 바에 따라 위원회에 신고하여야 한다. <개정 2023.3.7>
(3) When appointing a radiation safety manager under Article 53-3 (1) and (3) of the Act, or appointing one after changing or dismissing an appointed radiation safety manager, the person shall report to the Commission, as prescribed by Ordinance of the Prime Minister, by the following deadlines:
1. 법 제53조의3제1항 전단에 따라 방사선안전관리자를 선임하는 경우: 방사성동위원소등의 사용개시 전
1. Where appointing a radiation safety manager under the first sentence of Article 53-3 (1) of the Act: before commencing use of radioisotopes, etc.;
2. 법 제53조의3제1항 후단에 따라 방사선안전관리자를 변경하려는 경우: 변경 전
2. Where intending to change a radiation safety manager under the latter sentence of Article 53-3 (1) of the Act: before the change; and
3. 법 제53조의3제3항에 따라 방사선안전관리자를 해임 후 선임하는 경우: 해임한 날부터 30일 이내
3. Where appointing a radiation safety manager after dismissal under Article 53-3 (3) of the Act: within 30 days from the date of dismissal.
