약사법 제50조(의약품 판매)

①약국개설자 및 의약품판매업자는 그 약국 또는 점포 이외의 장소에서 의약품을 판매하여서는 아니 된다. 다만, 시장ㆍ군수ㆍ구청장의 승인을 받은 경우에는 예외로 한다.

②약국개설자는 의사 또는 치과의사의 처방전에 따라 조제하는 경우 외에는 전문의약품을 판매하여서는 아니 된다. 다만, 「수의사법」에 따른 동물병원 개설자에게 보건복지부령으로 정하는 바에 따라 판매하는 경우에는 그러하지 아니하다. <개정 2008.2.29, 2010.1.18>

③ 약국개설자는 제2항 단서에 따라 동물병원 개설자에게 전문의약품을 판매한 경우에는 의약품관리종합정보센터에 그 동물병원의 명칭, 연락처, 의약품의 명칭, 수량, 판매일 등의 판매 내역을 보건복지부령으로 정하는 바에 따라 제출하여야 한다. <신설 2024.12.20>

④약국개설자는 의사 또는 치과의사의 처방전이 없이 일반의약품을 판매할 수 있다. <개정 2024.12.20>

⑤약국개설자는 일반의약품을 판매할 때에 필요하다고 판단되면 복약지도를 할 수 있다. <개정 2024.12.20>
