시체 해부 및 보존 등에 관한 법률 제18조의2(보고와 조사)

① 보건복지부장관은 정당한 사유 없이 시체를 훼손하는 것을 방지하고 시체에 대한 예의를 지키도록 하기 위하여 필요하다고 인정할 때에는 제9조의4제1항에 따라 허가를 받은 기관의 장 및 그 종사자와 시체의 전부 또는 일부를 이용하여 연구하는 자에게 보건복지부령으로 정하는 바에 따라 이 법의 시행에 필요한 보고 또는 자료의 제출을 명할 수 있다. <개정 2025.11.11>

② 보건복지부장관은 정당한 사유 없이 시체가 훼손되거나 시체에 대한 예의가 지켜지지 못할 우려가 있을 때에는 시체의 전부 또는 일부의 제공 또는 연구의 중단을 명하거나 그 밖에 필요한 조치를 할 수 있다. <개정 2025.11.11>

③ 보건복지부장관은 이 법에서 정하고 있는 사항의 이행 또는 위반 여부의 확인을 위하여 필요하다고 인정할 때에는 관계 공무원으로 하여금 제9조의4제1항에 따라 허가를 받은 기관 및 시체의 전부 또는 일부를 이용하여 연구하는 자가 소속된 기관 등에 출입하여 그 시설 또는 장비, 관계 장부나 서류 및 그 밖의 물건을 검사하게 하거나 관계인에게 질문하게 할 수 있으며, 시험에 필요한 시료(試料)를 최소분량으로 수거하게 할 수 있다. 이 경우 관계 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다. <개정 2025.11.11>
