선박평형수(船舶平衡水) 관리법 시행규칙 제31조의2(형식승인시험의 완화ㆍ면제)

① 법 제17조제4항에 따라 형식승인시험의 완화ㆍ면제를 신청하려는 자는 별지 제13호의2서식의 선박평형수처리설비 형식승인시험의 완화ㆍ면제 신청서에 다음 각 호의 서류를 첨부하여 법 제20조의2제1항에 따른 독립시험기관(이하 "독립시험기관"이라 한다)에 제출해야 한다.

② 독립시험기관은 제1항에 따라 제출받은 신청서류 사본을 해양수산부장관에게 송부하고, 해양수산부장관이 추천하는 형식승인시험 관련 전문가로 기술평가단을 구성하여 외국정부 또는 외국정부가 공인한 시험기관의 형식승인시험이 형식승인시험기준과 동등 이상의 기준을 갖추었는지를 심의해야 한다. 이 경우 독립시험기관은 자료심의에 필요하다고 인정되면 외국정부 또는 외국정부가 공인한 시험기관에 대해 실제 조사를 요청할 수 있다. <개정 2021.6.30>

③ 독립시험기관은 제1항에 따른 신청서류에 제2항에 따른 심의 결과를 첨부하여 해양수산부장관에게 제출해야 한다.

④ 해양수산부장관은 제3항에 따라 제출받은 신청서류 및 심의결과를 검토한 후 법 제17조제4항에 따른 형식승인시험의 일부 또는 전부에 대한 완화 또는 면제 여부를 제1항에 따라 신청을 한 자 및 독립시험기관에 각각 통보해야 한다.
