산림자원의 조성 및 관리에 관한 법률 시행규칙 제17조(재해에 대한 보상절차 등)

①법 제17조제2항에 따른 묘목생산사업에 대한 재해의 보상을 받으려는 자는 그 사유가 발생한 날부터 30일 이내에 별지 제14호서식에 따른 신청서를 산림청장 또는 시ㆍ도지사에게 제출하여야 한다. 다만, 영 제15조제2항 단서에 따라 재원의 관리ㆍ운용이 산림조합중앙회장에게 위탁된 경우에는 산림조합중앙회장에게 제출하여야 한다. <개정 2012.12.24>

②제1항의 신청을 받은 산림청장, 시ㆍ도지사 또는 산림조합중앙회장은 관계 공무원 또는 산림조합중앙회(산림조합을 포함한다)의 직원으로 하여금 별지 제15호서식에 따른 현지조사서를 작성하게 하고 보상금 지급 여부를 결정한 후 그 결과를 신청일부터 60일 이내에 신청인에게 통지하여야 한다. <개정 2012.12.24>

③영 제15조제2항 단서에 따라 산림조합중앙회장이 재해보상의 재원을 관리ㆍ운영하는 경우에는 보상금 지급기준, 재원의 관리ㆍ운영에 관한 지침을 작성하여 산림청장의 승인을 얻어야 한다.
