사회기반시설에 대한 민간투자법 제3조의2(정부조달협정등의 적용 범위 및 원칙)

① 정부조달협정 또는 국제협정(이하 "정부조달협정등"이라 한다)이 적용되는 민간투자사업의 범위는 주무관청이 이 법에 따라 추진하는 민간투자사업 중 총사업비(사회기반시설사업에 드는 경비로서 대통령령으로 정하는 비용을 합산한 금액을 말한다. 이하 같다)가 기획예산처장관이 정하여 고시하는 금액 이상인 민간투자사업으로 한다. 다만, 정부조달협정등에 규정된 내용으로서 대통령령으로 정하는 경우에는 정부조달협정등이 적용되는 민간투자사업의 범위에서 제외한다. <개정 2025.10.1>

② 제1항 본문에 따른 주무관청의 범위는 정부조달협정등의 내용에 따라 대통령령으로 정한다.

③ 주무관청은 제1항 본문에 따라 정부조달협정등이 적용되는 민간투자사업을 추진하는 경우에는 정부조달협정등의 가입국 또는 체결국의 공급자를 대한민국의 공급자와 동일하게 대우하여야 하며, 민간투자사업과 관련된 정보를 차별적으로 제공하여서는 아니 된다.

④ 주무관청은 제1항 본문에 따른 정부조달협정등의 적용대상에서 제외되는 민간투자사업의 경우에도 해당 민간투자사업의 목적ㆍ성질 등을 고려할 때 국제입찰에 의하여 사업을 수행할 필요가 있는 경우로서 대통령령으로 정하는 경우에는 정부조달협정등을 적용하여 민간투자사업을 시행할 수 있다.
