부동산등기법 제90조(가등기를 명하는 가처분명령)

① 제89조의 가등기를 명하는 가처분명령은 부동산의 소재지를 관할하는 지방법원이 가등기권리자의 신청으로 가등기 원인사실의 소명이 있는 경우에 할 수 있다.

② 제1항의 신청을 각하한 결정에 대하여는 즉시항고(卽時抗告)를 할 수 있다.
