병역법 시행령 제147조(국외여행기간 연장허가 등)

① 법 제70조제3항에 따라 국외여행기간 연장허가를 받으려는 사람은 병무청장이 정하는 체재목적을 증명하는 서류와 국외여행기간 연장허가 신청서(전자문서로 된 신청서를 포함한다)를 재외공관의 장을 거쳐 병무청장에게 제출하여야 한다. 다만, 제146조제1항제7호 및 제9호 외의 사유로 국외여행기간 연장허가를 받으려는 사람은 재외공관의 장을 거치지 아니하고 병무청장에게 제출할 수 있다.

② 병무청장은 제1항에 따른 국외여행기간 연장허가 신청서를 받은 경우에는 국외체재 목적을 고려하여 병역의무부과에 지장이 없다고 인정되는 범위에서 허가할 수 있다. 다만, 외국의 학교(고등학교는 제외한다)에 재학 중인 사람은 제124조에 따른 학교별 제한연령까지 허가하되, 학교별 제한연령 내에 졸업이나 학위취득이 곤란한 사람에 대해서는 29세를 초과하지 아니하는 범위에서 학교별 제한연령에 1년을 더한 기간까지 허가할 수 있다. <개정 2012.12.20>

③ 병무청장은 제2항 단서에도 불구하고 외국의 대학원에 재학 중인 사람이 30세가 되는 해의 6월 이전에 박사학위를 취득할 수 있는 경우에는 30세가 되는 해의 6월 30일까지 허가할 수 있다. <개정 2012.12.20>

④ 병무청장은 제2항 및 제3항에 따라 국외여행기간 연장허가 여부를 결정한 경우에는 그 결과를 지체 없이 재외공관의 장에게 통보하여 본인에게 통지하도록 하여야 한다.
