민사조정법 제7조(조정기관)

① 조정사건은 조정담당판사가 처리한다.

② 조정담당판사는 스스로 조정을 하거나, 상임(常任)으로 이 법에 따른 조정에 관한 사무를 처리하는 조정위원(이하 "상임 조정위원"이라 한다) 또는 조정위원회로 하여금 조정을 하게 할 수 있다. 다만, 당사자의 신청이 있을 때에는 조정위원회로 하여금 조정을 하게 하여야 한다.

③ 제6조에 따라 수소법원이 조정에 회부한 사건으로서 수소법원이 스스로 조정하는 것이 적절하다고 인정한 사건은 제1항 및 제2항에도 불구하고 스스로 처리할 수 있다.

④ 제2항 본문 및 제3항에 따라 조정을 하는 상임 조정위원과 수소법원은 조정담당판사와 동일한 권한을 가진다.

⑤ 제3항의 경우에 수소법원은 수명법관(受命法官)이나 수탁판사(受託判事)로 하여금 조정을 담당하게 할 수 있다. 이 경우 수명법관이나 수탁판사는 조정담당판사와 동일한 권한을 가진다.

⑥ 조정담당판사가 제2항에 따라 스스로 조정을 하거나 조정위원회로 하여금 조정을 하게 하는 경우 조정담당판사나 조정장(調停長)은 조정위원으로 하여금 분쟁해결방안을 도출하기 위하여 사건관계인의 의견을 들어 합의안을 도출하거나 그 밖에 조정사건의 처리를 위하여 필요한 사무를 수행하게 할 수 있다. <신설 2020.2.4>
