민사소송법 제126조(담보물변경)

법원은 담보제공자의 신청에 따라 결정으로 공탁한 담보물을 바꾸도록 명할 수 있다. 다만, 당사자가 계약에 의하여 공탁한 담보물을 다른 담보로 바꾸겠다고 신청한 때에는 그에 따른다.
