도시 및 주거환경정비법 제64조(재건축사업에서의 매도청구)

① 재건축사업의 사업시행자는 사업시행계획인가의 고시가 있은 날부터 30일 이내에 다음 각 호의 자에게 조합설립 또는 사업시행자의 지정에 관한 동의 여부를 회답할 것을 서면으로 촉구하여야 한다.

(1) Within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 public퍼블릭 notice노우티스 of어^v브 the^ð디 approval어프^r루^v블 of어^v브 the^ð더 project프^r라젝트 implementation임플러멘테이션 plan,플랜 the^ð더 project프^r라젝트 implementer임플리먼터 of어^v브 a어 housing하우징 reconstruction^r리컨스트^r럭션 project프^r라젝트 shall섈 urge얼지 in인 writing^r라이팅 each이치 of어^v브 the^ð더 following^f팔로잉 persons퍼슨즈 to투 reply^r리플라이 whether웨^ð더 he히 or오 she쉬 consents컨센츠 to투 the^ð디 establishment이스태블리시먼트 of어^v브 the^ð디 association어소우시에이션 or오 the^ð더 designation데저그네이션 of어^v브 the^ð더 project프^r라젝트 implementer:임플리먼터

② 제1항의 촉구를 받은 토지등소유자는 촉구를 받은 날부터 2개월 이내에 회답하여야 한다.

(2) An앤 owner오우너 of어^v브 land,랜드 etc.엣세터^r러 who후 has해즈 been빈 urged얼지드 under언더 paragraph패^r러그^r래^f프 (1) shall섈 reply^r리플라이 within위^ð딘 two투 months먼^θ쓰 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 it.잇

③ 제2항의 기간 내에 회답하지 아니한 경우 그 토지등소유자는 조합설립 또는 사업시행자의 지정에 동의하지 아니하겠다는 뜻을 회답한 것으로 본다.

(3) If이^f프 an앤 owner오우너 of어^v브 land,랜드 etc.엣세터^r러 fails^f페일즈 to투 reply^r리플라이 within위^ð딘 the^ð더 period피^r리어드 under언더 paragraph패^r러그^r래^f프 (2), he히 or오 she쉬 shall섈 be비 deemed딤드 to투 have해^v브 replied^r리플라이드 that^ð댓 he히 or오 she쉬 does더즈 not낫 consent컨센트 to투 the^ð디 establishment이스태블리시먼트 of어^v브 the^ð디 association어소우시에이션 or오 the^ð더 designation데저그네이션 of어^v브 the^ð더 project프^r라젝트 implementer.임플리먼터

④ 제2항의 기간이 지나면 사업시행자는 그 기간이 만료된 때부터 2개월 이내에 조합설립 또는 사업시행자 지정에 동의하지 아니하겠다는 뜻을 회답한 토지등소유자와 건축물 또는 토지만 소유한 자에게 건축물 또는 토지의 소유권과 그 밖의 권리를 매도할 것을 청구할 수 있다.
