기업활동 규제완화에 관한 특별조치법 제54조(배출허용기준의 특례)

1. 48시간 전에 통보되지 아니한 단전(斷電)ㆍ단수(斷水)로 인하여 배출시설 또는 방지시설을 적정하게 운영할 수 없는 경우

2. 천재지변, 화재 또는 그 밖의 불가항력적인 사유로 배출시설 또는 방지시설을 적정하게 운영할 수 없는 경우

3. 화재ㆍ폭발 등의 위험이 있는 경우 안전사고 예방을 위하여 「고압가스 안전관리법」 제4조제4항에 따라 산업통상부령으로 정하는 기준에 따른 플레어스택(flarestack)을 가동하거나 그 밖의 다른 법령에서 정한 시설을 가동하는 경우. 다만, 배출시설 및 방지시설의 정상가동 상태에서 일정한 시간 동안 부적정하게 운영하는 등 대통령령으로 정하는 경우는 제외한다.
