금융지주회사법 제6조의2(자본금 및 정관 변경의 신고)

①금융지주회사는 자본금을 감소시키거나 정관을 변경하려는 때에는 금융위원회에 미리 신고하여야 한다. 다만, 정관의 변경사항 중 금융위원회가 정하는 경미한 사항을 변경하는 때에는 변경한 날부터 7일 이내에 그 사실을 금융위원회에 보고하여야 한다. <개정 2008.2.29>

② 금융위원회는 제1항 본문에 따른 신고를 받은 날부터 14일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.12.31>

③ 금융위원회가 제2항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.12.31>

④금융위원회는 제1항 본문에 따라 신고받은 내용이 관계 법령에 위반되거나 금융지주회사의 경영의 건전성을 훼손할 우려가 있는 경우에는 해당 금융지주회사에 시정하거나 보완할 것을 권고할 수 있다. <개정 2008.2.29, 2018.12.31>
