Enforcement Decree of the Military Personnel Act, Article 9-2 (Measures Against Persons Who Commit Misconduct in Examinations)

① 시험실시기관의 장은 법 제9조의2제1항에 따라 장교, 장교후보생, 예비 장교후보생, 준사관 및 부사관 임용시험에서 다음 각 호의 어느 하나에 해당하는 행위를 한 사람에 대해서는 그 시험을 정지 또는 무효로 하거나 합격을 취소하고, 그 처분이 있은 날부터 5년간 장교, 장교후보생, 예비 장교후보생, 준사관 및 부사관 임용시험의 응시자격을 정지한다. <개정 2026.8.3>

② 시험실시기관의 장은 법 제9조의2제1항 전단에 따라 장교, 장교후보생, 예비 장교후보생, 준사관 및 부사관 임용시험에서 다음 각 호의 어느 하나에 해당하는 행위를 한 사람에 대해서는 그 시험을 정지하거나 무효로 한다. <개정 2026.8.3>

③ 다른 법령에 의한 국가공무원 또는 지방공무원의 임용시험에서 부정한 행위를 하여 응시자격이 정지된 사람은 그 정지기간에는 장교, 장교후보생, 예비 장교후보생, 준사관 및 부사관 임용시험에 응시할 수 없다.

④ 시험실시기관의 장은 제1항에 따른 처분을 하였을 때에는 지체 없이 그 이유를 붙여 처분을 받은 사람에게 알리고, 그 명단을 관보에 게재하여야 한다.

⑤ 부정행위를 한 사람이 공무원인 경우 시험실시기관의 장은 관할 징계위원회에 징계의결을 요구하거나 그 공무원의 소속기관의 장에게 징계를 요구하여야 한다.
