군인사법 시행령 제37조(발령)

① 진급 발령은 수시로 하며, 그 인원은 진급시킬 당시의 궐원에 따른다.

(1) Promotion프^r러모우션 orders오더즈 shall섈 be비 issued이슈드 from^f프^r럼 time타임 to투 time,타임 and앤드 the^ð더 number넘버 of어^v브 persons퍼슨즈 shall섈 follow^f팔로 the^ð더 vacancies^v베이컨시즈 at앳 the^ð더 time타임 of어^v브 promotion.프^r러모우션

② 진급 예정자로서 해당 연도에 진급되지 못한 사람은 그 순위에 따라 다음 진급연도의 진급 예정자보다 우선하여 진급시킨다.

(2) A어 person퍼슨 scheduled스케줄드 for^f포 promotion프^r러모우션 who후 was워즈 not낫 promoted프^r러모우티드 in인 the^ð더 relevant^r렐러^v번트 year이어 shall섈 be비 promoted프^r러모우티드 in인 order오더 of어^v브 rank^r랭크 ahead어헤드 of어^v브 persons퍼슨즈 scheduled스케줄드 for^f포 promotion프^r러모우션 in인 the^ð더 next넥스트 promotion프^r러모우션 year.이어

③ 진급 예정자 명단의 순위상 진급 발령될 사람으로서 법 제26조제1항 및 제2항에 따른 진급 최저복무기간에 이르지 아니한 사람은 그 진급 최저복무기간에 이를 때까지 발령을 보류한다.
