국가유산수리 등에 관한 법률 제35조(국가유산수리업자의 하자담보책임)

① 국가유산수리업자는 발주자에 대하여 국가유산수리의 완공일부터 10년 이내의 범위에서 대통령령으로 정하는 국가유산수리의 종류별 하자담보책임 기간에 발생하는 하자에 대하여 담보책임이 있다. <개정 2023.8.8>

② 국가유산수리업자는 다음 각 호의 어느 하나에 해당하는 사유로 발생한 하자에 대하여는 제1항에도 불구하고 하자담보책임이 없다. 다만, 국가유산수리업자가 그 재료 또는 지시가 적당하지 아니함을 알고도 발주자에게 알리지 아니한 경우에는 그러하지 아니하다. <개정 2023.8.8>

③ 제1항에도 불구하고 국가유산수리업자와 발주자 사이에 체결한 도급 계약서에 국가유산수리업자의 하자담보책임에 관한 특약을 정한 경우에는 그 특약에 따른다. 다만, 그 특약에서 하자담보책임기간을 제1항에 따른 기간의 3분의 2 미만으로 정한 경우에는 그 기간의 3분의 2로 정한 것으로 본다. <개정 2023.8.8>
