국가공무원법 제45조의2(채용시험 등 부정행위자에 대한 조치)

① 시험실시기관의 장은 채용시험ㆍ승진시험, 그 밖의 시험에서 다른 사람에게 대신하여 응시하게 하는 행위 등 대통령령으로 정하는 부정행위를 한 사람에 대하여 대통령령으로 정하는 바에 따라 해당 시험의 정지ㆍ무효 또는 합격 취소 처분을 할 수 있다. 이 경우 처분을 받은 사람에 대하여는 처분이 있은 날부터 5년의 범위에서 대통령령으로 정하는 기간 동안 채용시험ㆍ승진시험, 그 밖의 시험의 응시자격을 정지할 수 있다.

② 시험실시기관의 장은 제1항에 따른 처분(시험의 정지는 제외한다)을 하려는 때에는 미리 그 처분 내용과 사유를 당사자에게 통지하여 소명할 기회를 주어야 한다.
