교육공무원법 제32조의2(장학금 지급 및 의무복무)

① 교육감은 교원을 안정적으로 확보하기 위하여 시ㆍ도의 조례로 정하는 기준을 충족한 사람을 교육대학의 장에게 교육대학 입학 또는 편입학 대상자로 추천할 수 있다.

② 교육감은 제1항에 따른 추천을 받아 교육대학에 입학하거나 편입학한 사람에게 장학금을 지급할 수 있다.

③ 교육감은 제2항에 따라 장학금을 받는 사람에 대하여 교육대학을 졸업한 후 4년의 범위에서 해당 관할지역에서 실시되는 교사 공개전형에 응시하여 합격한 경우에는 장학금을 받은 기간의 2배의 범위에서 시ㆍ도의 조례로 정하는 기간 동안 교육감이 정하는 지역에서 복무하도록 의무를 부과할 수 있다.

④ 교육감은 제2항에 따라 장학금을 받고 있거나 받은 사람이 다음 각 호의 어느 하나에 해당하는 경우에는 시ㆍ도의 조례로 정하는 바에 따라 본인에게 장학금의 전부 또는 일부를 반납할 것을 명할 수 있고, 본인이 반납하지 아니할 경우 그의 보증인(「보험업법」에 따라 보증보험증권을 발행한 보험회사를 포함한다)에게 보증채무의 이행을 청구할 수 있으며 반납하지 아니하면 지방세 체납처분의 예에 따라 징수할 수 있다. 다만, 의무복무기간 중 공무상 질병으로 퇴직한 경우 등 시ㆍ도의 조례로 정하는 불가피한 사유가 있는 경우에는 그러하지 아니하다. <개정 2022.10.18>
