관광진흥법 제78조(보고ㆍ검사)

①지방자치단체의 장은 문화체육관광부령으로 정하는 바에 따라 관광진흥정책의 수립ㆍ집행에 필요한 사항과 그 밖에 이 법의 시행에 필요한 사항을 문화체육관광부장관에게 보고하여야 한다. <개정 2008.2.29>

②관할 등록기관등의 장은 관광진흥시책의 수립ㆍ집행 및 이 법의 시행을 위하여 필요하면 관광사업자 단체 또는 관광사업자에게 그 사업에 관한 보고를 하게 하거나 서류를 제출하도록 명할 수 있다.

③관할 등록기관등의 장은 관광진흥시책의 수립ㆍ집행 및 이 법의 시행을 위하여 필요하다고 인정하면 소속 공무원에게 관광사업자 단체 또는 관광사업자의 사무소ㆍ사업장 또는 영업소 등에 출입하여 장부ㆍ서류나 그 밖의 물건을 검사하게 할 수 있다.

④ 관할 등록기관등의 장은 외국인관광 도시민박업용 시설 및 한옥체험업용 시설에 제20조의4에 따라 설치가 금지되는 카메라나 그 밖에 이와 유사한 기능을 갖춘 기계장치가 설치되었는지를 검사할 수 있다. 이 경우 외국인관광 도시민박업 또는 한옥체험업의 등록을 한 자는 특별한 사정이 없으면 검사에 따라야 한다. <신설 2025.11.11>

⑤제3항 및 제4항의 경우 관계 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다. <개정 2025.11.11>
