공직선거법 제86조(공무원 등의 선거에 영향을 미치는 행위금지)
Public Official Election Act, Article 86 (Prohibition of Acts by Public Officials, etc. Affecting Elections)
①공무원(국회의원과 그 보좌관ㆍ선임비서관ㆍ비서관 및 지방의회의원을 제외한다), 선상투표신고를 한 선원이 승선하고 있는 선박의 선장, 제53조제1항제4호 및 제6호에 규정된 기관 등의 상근 임원, 통ㆍ리ㆍ반의 장, 주민자치위원회위원과 예비군 중대장급 이상의 간부, 특별법에 의하여 설립된 국민운동단체로서 국가나 지방자치단체의 출연 또는 보조를 받는 단체(바르게살기운동협의회ㆍ새마을운동협의회ㆍ한국자유총연맹을 말한다)의 상근 임ㆍ직원 및 이들 단체 등(시ㆍ도조직 및 구ㆍ시ㆍ군조직을 포함한다)의 대표자는 다음 각 호의 어느 하나에 해당하는 행위를 하여서는 아니된다. <개정 1997.11.14, 2000.2.16, 2002.3.7, 2004.3.12, 2005.8.4, 2010.1.25, 2012.1.17, 2012.2.29, 2014.1.17, 2016.5.29, 2020.3.25, 2022.4.20, 2025.1.7>
(1) Public officials (excluding members of the National Assembly and their aides, senior secretaries and secretaries, and members of local councils), captains of ships on which seafarers who have reported for shipboard voting are aboard, full-time officers of the institutions, etc. specified in Article 53 (1) 4 and 6, heads of Tong/Ri/Ban, members of resident autonomy committees, reserve forces officers at company commander level or above, full-time officers and employees of national movement organizations established under special Acts that receive contributions or subsidies from the State or local governments (meaning the Council of the Righteous Living Movement, the Council of the Saemaul Movement and the Korea Freedom Federation), and the representatives of such organizations, etc. (including their Si/Do and Gu/Si/Gun branches), shall not engage in any of the following acts:
1. 소속직원 또는 선거구민에게 교육 기타 명목여하를 불문하고 특정 정당이나 후보자(후보자가 되고자 하는 자를 포함한다. 이하 이 항에서 같다)의 업적을 홍보하는 행위
1. Publicizing the achievements of a particular political party or candidate (including a person who intends to become a candidate; the same shall apply hereinafter in this paragraph) to staff under them or residents of the constituency, whether in the name of education or any other name;
2. 지위를 이용하여 선거운동의 기획에 참여하거나 그 기획의 실시에 관여하는 행위
2. Taking part in planning election campaigns, or being involved in carrying out such plans, by using their positions;
3. 정당 또는 후보자에 대한 선거권자의 지지도를 조사하거나 이를 발표하는 행위

5. 선거기간중 국가 또는 지방자치단체의 예산으로 시행하는 사업중 즉시 공사를 진행하지 아니할 사업의 기공식을 거행하는 행위
5. During the election period, holding groundbreaking ceremonies for projects funded by the budget of the State or a local government on which construction will not start immediately;
6. 선거기간중 정상적 업무외의 출장을 하는 행위

②지방자치단체의 장(제4호의 경우 소속 공무원을 포함한다)은 선거일전 60일(선거일전 60일후에 실시사유가 확정된 보궐선거등에 있어서는 선거의 실시사유가 확정된 때)부터 선거일까지 다음 각 호의 어느 하나에 해당하는 행위를 하여서는 아니된다. <신설 1995.12.30, 1997.11.14, 1998.4.30, 2000.2.16, 2002.3.7, 2004.3.12, 2010.1.25, 2011.7.28>
(2) The head of a local government (including public officials under him or her, in the case of subparagraph 4) shall not engage in any of the following acts from 60 days before election day (for a by-election, etc. whose cause for holding it is finalized later than 60 days before election day, from the time the cause for holding the election is finalized) until election day:

2. 정당의 정강ㆍ정책과 주의ㆍ주장을 선거구민을 대상으로 홍보ㆍ선전하는 행위. 다만, 당해 지방자치단체의 장의 선거에 예비후보자 또는 후보자가 되는 경우에는 그러하지 아니하다.
2. Publicizing or promoting the platform, policies, principles and claims of a political party to residents of the constituency. However, this shall not apply where he or she becomes a preliminary candidate or candidate in the election of the head of that local government;
3. 창당대회ㆍ합당대회ㆍ개편대회 및 후보자선출대회를 제외하고는 정당이 개최하는 시국강연회, 정견ㆍ정책발표회, 당원연수ㆍ단합대회 등 일체의 정치행사에 참석하거나 선거대책기구, 선거사무소, 선거연락소를 방문하는 행위. 다만, 해당 지방자치단체의 장선거에 예비후보자 또는 후보자가 된 경우와 당원으로서 소속 정당이 당원만을 대상으로 개최하는 정당의 공개행사에 의례적으로 방문하는 경우에는 그러하지 아니하다.
3. Attending any political event held by a political party, such as lectures on current affairs, presentations of political views and policies, and training or unity gatherings for party members, other than conventions for founding or merging parties, reorganization conventions and conventions for selecting candidates, or visiting election strategy organizations, election campaign offices or election liaison offices. However, this shall not apply where he or she has become a preliminary candidate or candidate in the election of the head of that local government, or where, as a party member, he or she makes a customary visit to a public party event held by his or her political party for party members only;
4. 다음 각 목의 1을 제외하고는 교양강좌, 사업설명회, 공청회, 직능단체모임, 체육대회, 경로행사, 민원상담 기타 각종 행사를 개최하거나 후원하는 행위
4. Holding or sponsoring cultural lectures, business briefings, public hearings, meetings of occupational organizations, sports events, events for the elderly, consultations on civil petitions or any other events, except for any of the following items:
가. 법령에 의하여 개최하거나 후원하도록 규정된 행사를 개최ㆍ후원하는 행위
(a) Holding or sponsoring events that statutes require to be held or sponsored;
나. 특정일ㆍ특정시기에 개최하지 아니하면 그 목적을 달성할 수 없는 행사
(b) Events whose purpose cannot be achieved unless held on a particular day or at a particular time;
다. 천재ㆍ지변 기타 재해의 구호ㆍ복구를 위한 행위
(c) Acts for relief and recovery from natural disasters or other calamities;
라. 직업지원교육 또는 유상(有償)으로 실시하는 교양강좌를 개최ㆍ후원하는 행위 또는 주민자치센터가 개최하는 교양강좌를 후원하는 행위. 다만, 종전의 범위를 넘는 새로운 강좌를 개설하거나 수강생을 증원하거나 장소를 이전하여 실시하는 주민자치센터의 교양강좌를 후원하는 행위를 제외한다.
(d) Holding or sponsoring vocational training or cultural lectures offered for a fee, or sponsoring cultural lectures held by resident autonomy centers. However, this excludes sponsoring cultural lectures of resident autonomy centers that open new courses beyond the previous scope, increase the number of students, or move to another location;
마. 집단민원 또는 긴급한 민원이 발생하였을 때 이를 해결하기 위한 행위
(e) Acts to resolve group civil petitions or urgent civil petitions when they arise;
바. 가목 내지 마목에 준하는 행위로서 중앙선거관리위원회규칙으로 정하는 행위
(f) Acts equivalent to items (a) through (e) as prescribed by the Rules of the National Election Commission;
5. 통ㆍ리ㆍ반장의 회의에 참석하는 행위. 다만, 천재ㆍ지변 기타 재해가 있거나 집단민원 또는 긴급한 민원이 발생하였을 때에는 그러하지 아니하다.
5. Attending meetings of heads of Tong/Ri/Ban. However, this shall not apply where there is a natural disaster or other calamity, or where a group civil petition or urgent civil petition has arisen.

⑤지방자치단체의 장(소속 공무원을 포함한다)은 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 지방자치단체의 사업계획ㆍ추진실적 그 밖에 지방자치단체의 활동상황을 알리기 위한 홍보물(홍보지ㆍ소식지ㆍ간행물ㆍ시설물ㆍ녹음물ㆍ녹화물 그 밖의 홍보물 및 신문ㆍ방송을 이용하여 행하는 경우를 포함한다)을 분기별로 1종 1회를 초과하여 발행ㆍ배부 또는 방송하여서는 아니되며 당해 지방자치단체의 장의 선거의 선거일전 180일(보궐선거 등에 있어서는 그 선거의 실시사유가 확정된 때, 이하 제6항에서 같다)부터 선거일까지는 홍보물을 발행ㆍ배부 또는 방송할 수 없다. <신설 1998.4.30, 2000.2.16, 2004.3.12, 2006.3.2, 2010.1.25>
(5) Except in any of the following cases, the head of a local government (including public officials under him or her) shall not publish, distribute or broadcast publicity materials (including publicity leaflets, newsletters, publications, facilities, sound recordings, video recordings and other publicity materials, and publicity using newspapers and broadcasting) to inform the public of the local government's business plans, achievements or other activities more than once per kind per quarter, and may not publish, distribute or broadcast publicity materials from 180 days before election day of the election of the head of that local government (for a by-election, etc., from the time the cause for holding the election is finalized; the same shall apply hereinafter in paragraph (6)) until election day:
1. 법령에 의하여 발행ㆍ배부 또는 방송하도록 규정된 홍보물을 발행ㆍ배부 또는 방송하는 행위
1. Publishing, distributing or broadcasting publicity materials that statutes require to be published, distributed or broadcast;
2. 특정사업을 추진하기 위하여 그 사업과 이해관계가 있는 자나 관계주민의 동의를 얻기 위한 행위
2. Acts to obtain the consent of persons with an interest in a particular project or of the residents concerned, in order to carry out that project;
3. 집단민원 또는 긴급한 민원이 발생하였을 때 이를 해결하기 위한 행위
3. Acts to resolve group civil petitions or urgent civil petitions when they arise;
4. 기타 위 각호의 1에 준하는 행위로서 중앙선거관리위원회규칙이 정하는 행위
4. Other acts equivalent to any of the above subparagraphs as prescribed by the Rules of the National Election Commission.
⑥지방자치단체의 장은 당해 지방자치단체의 장의 선거의 선거일전 180일부터 선거일까지 주민자치센터가 개최하는 교양강좌에 참석할 수 없으며, 근무시간중에 공공기관이 아닌 단체 등이 주최하는 행사(해당 지방자치단체의 청사에서 개최하는 행사를 포함한다)에는 참석할 수 없다. 다만, 제2항제3호에 따라 참석 또는 방문할 수 있는 행사의 경우에는 그러하지 아니하다. <신설 1998.4.30, 2002.3.7, 2010.1.25>
(6) From 180 days before election day of the election of the head of a local government until election day, the head of that local government may not attend cultural lectures held by resident autonomy centers, and may not, during working hours, attend events hosted by organizations, etc. other than public institutions (including events held in the government building of that local government). However, this shall not apply to events he or she may attend or visit under paragraph (2) 3.
⑦ 지방자치단체의 장은 소관 사무나 그 밖의 명목 여하를 불문하고 방송ㆍ신문ㆍ잡지나 그 밖의 광고에 출연할 수 없다. <신설 2010.1.25>
(7) The head of a local government may not appear in broadcasting, newspaper, magazine or other advertisements, whether in connection with the affairs under his or her jurisdiction or under any other name.
