공직선거법 제268조(공소시효)

①이 법에 규정한 죄의 공소시효는 당해 선거일후 6개월(선거일후에 행하여진 범죄는 그 행위가 있는 날부터 6개월)을 경과함으로써 완성한다. 다만, 범인이 도피한 때나 범인이 공범 또는 범죄의 증명에 필요한 참고인을 도피시킨 때에는 그 기간은 3년으로 한다. <개정 2004.3.12, 2012.2.29>

② 제1항 본문에도 불구하고 선상투표와 관련하여 선박에서 범한 이 법에 규정된 죄의 공소시효는 범인이 국내에 들어온 날부터 6개월을 경과함으로써 완성된다. <신설 2012.2.29>

③ 제1항 및 제2항에도 불구하고 공무원(제60조제1항제4호 단서에 따라 선거운동을 할 수 있는 사람은 제외한다)이 직무와 관련하여 또는 지위를 이용하여 범한 이 법에 규정된 죄의 공소시효는 해당 선거일 후 10년(선거일 후에 행하여진 범죄는 그 행위가 있는 날부터 10년)을 경과함으로써 완성된다. <신설 2014.2.13>
