공공주택 특별법 제49조의2(공공임대주택의 표준임대차계약서 등)

① 공공임대주택에 대한 임대차계약을 체결하려는 자는 국토교통부령으로 정하는 표준임대차계약서를 사용하여야 한다.

② 제1항의 표준임대차계약서에는 다음 각 호의 사항이 포함되어야 한다.

③ 공공주택사업자가 임대차계약을 체결할 때 임대차 계약기간이 끝난 후 임대주택을 그 임차인에게 분양전환할 예정이면 「주택임대차보호법」 제4조제1항에도 불구하고 임대차 계약기간을 2년 이내로 할 수 있다.

④ 공공주택사업자는 임차인이 대통령령으로 정하는 공공임대주택에 입주하기 전까지 해당 공공임대주택의 세대 내 거실, 화장실 등 주거 공간의 시설 및 설비의 상태 등 국토교통부령으로 정하는 사항을 설명하고 이를 확인받아야 한다. <신설 2019.11.26>

⑤ 제4항에 따른 설명 및 확인의 시기, 방법 및 절차 등에 관한 사항은 대통령령으로 정한다. <신설 2019.11.26>
