고용정책 기본법 제15조의2(고용정보시스템의 구축ㆍ운영)

① 고용노동부장관은 제15조제1항의 업무를 효율적으로 수행하기 위하여 같은 항 각 호의 고용ㆍ직업 정보를 대상으로 하는 전자정보시스템(이하 "고용정보시스템")을 구축ㆍ운영할 수 있다.

② 고용노동부장관은 제1항에 따른 업무를 수행하기 위하여 법원ㆍ법무부ㆍ보건복지부ㆍ행정안전부ㆍ국세청 등 관계 중앙행정기관과 지방자치단체의 장 및 관련 기관ㆍ단체의 장에게 자료 제공 및 관계 전산망의 이용을 요청할 수 있다. 이 경우 자료의 제공 등을 요청받은 자는 정당한 사유가 없으면 그 요청에 따라야 한다. <개정 2023.3.28>

④ 고용노동부장관은 제2항 및 제3항에 따른 자료와 관계 전산망의 이용을 위하여 「사회보장기본법」 제37조제2항에 따른 사회보장정보시스템을 연계하여 사용할 수 있다.

⑤ 고용노동부장관은 재정지원 일자리사업 등 일자리 지원 업무를 수행하는 중앙행정기관, 지방자치단체 및 위탁받은 기관ㆍ단체(이하 "수행기관"이라 한다)의 장이 사업수행 및 관리를 위하여 개인정보 등의 활용을 요청하는 경우 고용정보시스템을 이용하거나 관할 전산망을 연계하여 개인정보 등을 이용하게 할 수 있다. 이 경우 수행기관으로의 정보 제공 및 이를 위한 정보시스템 운영에 소요되는 비용을 징수할 수 있다.

⑥ 제2항부터 제4항까지에 따른 자료 제공 및 관계 전산망 이용에 관하여는 수수료ㆍ사용료 등을 면제한다.
