고등교육법 제61조(휴업 및 휴교 명령)

① 교육부장관은 재해 등의 긴급한 사유로 정상수업이 불가능하다고 인정하면 학교의 장에게 휴업을 명할 수 있다. <개정 2013.3.23>

② 제1항에 따른 명령을 받은 학교의 장은 지체 없이 휴업을 하여야 한다.

(2) The^ð더 head헤드 of어^v브 a어 school스쿨 who후 has해즈 received^r러시^v브드 an앤 order오더 under언더 paragraph패^r러그^r래^f프 (1) shall섈 suspend서스펜드 classes클래시즈 without위^ð다웃 delay.딜레이

③ 교육부장관은 학교의 장이 제1항에 따른 명령에도 불구하고 휴업을 하지 아니하거나 특별히 긴급한 사유가 있는 경우에는 휴교처분을 할 수 있다. <개정 2013.3.23>

④ 제1항과 제2항에 따라 휴업한 학교는 휴업기간 중 수업과 학생의 등교가 정지되며, 제3항에 따라 휴교한 학교는 휴교기간 중 단순한 관리 업무 외에는 학교의 모든 기능이 정지된다.
