가족관계의 등록 등에 관한 법률 제52조(기아)

① 기아(棄兒)를 발견한 사람 또는 기아발견의 통지를 받은 경찰공무원은 24시간 이내에 그 사실을 시ㆍ읍ㆍ면의 장에게 통보하여야 한다. <개정 2020.12.22>

② 제1항의 통보를 받은 시ㆍ읍ㆍ면의 장은 소지품, 발견장소, 발견연월일시, 그 밖의 상황, 성별, 출생의 추정연월일을 조서에 기재하여야 한다. 이 경우 그 조서를 신고서로 본다.

③ 시ㆍ읍ㆍ면의 장은 「민법」 제781조제4항에 따라 기아의 성과 본을 창설한 후 이름과 등록기준지를 정하여 등록부에 기록하여야 한다.
