가정폭력범죄의 처벌 등에 관한 특례법 시행령 제4조(신변안전조치 종류의 변경 청구 등)

① 피해자 또는 그 법정대리인은 신변안전조치 종류의 변경이 필요하거나 또는 추가적인 신변안전조치가 필요한 경우 별지 제3호서식으로 법원에 신변안전조치의 종류 변경 또는 신변안전조치의 추가를 청구할 수 있다. 이 경우 제2조제1항 단서 및 제2항을 준용한다.

② 피해자 또는 그 법정대리인은 신변안전조치의 기간 중에 신변안전조치의 연장이 필요한 사유 및 그 기간을 구체적으로 기재하여 별지 제3호서식으로 법원에 신변안전조치의 연장을 청구할 수 있다. 이 경우 제2조제1항 단서 및 제2항을 준용한다.

③ 법원은 피해자 보호를 위하여 신변안전조치의 종류 변경, 신변안전조치의 추가 또는 기간 연장이 필요하다고 인정하는 경우에는 직권으로 또는 제1항ㆍ제2항에 따른 청구에 의하여 별지 제2호서식으로 검사에게 신변안전조치의 종류 변경, 신변안전조치의 추가 또는 기간 연장을 요청할 수 있다. 이 경우 제2조제1항 단서 및 제2항을 준용한다.
