Act on Compensation for Meritorious Irregular Forces Who Operated in Enemy Areas Around the Korean War, Article 8 (Decision on Payment)
① 위원회는 공로금의 지급신청을 받은 날부터 1년 이내에 그 지급여부와 금액을 결정하여야 한다. 다만, 사실조사의 지연 등으로 이 기간 이내에 결정할 수 없는 상당한 이유가 있는 경우에는 그러하지 아니하다.
(1) The Committee shall decide whether to pay and the amount within one year from the date of receiving an application for payment of a merit payment: Provided, That this shall not apply where there is a reasonable ground for being unable to decide within this period, such as delay in fact-finding.
② 위원회는 다음 각 호의 어느 하나에 해당하는 경우에는 별도의 심사ㆍ의결을 거치지 아니하고 공로금의 지급신청을 각하할 수 있다.
(2) The Committee may dismiss an application for payment of a merit payment without a separate review and resolution in any of the following cases:
1. 이미 위원회의 결정이 있음에도 불구하고 새로운 주장이나 증거 없이 동일한 내용의 지급신청을 한 경우
1. Where an application for payment with the same content is filed without new arguments or evidence even though there has already been a decision of the Committee;
2. 제2조제1호 각 목에서 정하는 조직이나 부대에 소속되지 아니한 사람을 공로자로 주장하여 지급신청을 한 경우
2. Where an application for payment is filed claiming that a person who does not belong to an organization or unit prescribed in each item of Article 2 subparagraph 1 is a meritorious person; and
3. 지급신청 후 신청인이 사망하거나 소재를 파악할 수 없어 사실조사가 불가능한 경우
3. Where fact-finding becomes impossible because the applicant died or cannot be located after applying for payment.
