Enforcement Decree of the Special Act on Investigation of the Truth about the May 18 Democratization Movement, Article 11-5 (Standards and Procedures for Recognizing Remains of Victims)
① 위원회는 발굴된 유해가 다음 각 호의 어느 하나에 해당하는 경우 법 제27조의2제5항에 따른 신원확인을 거쳐 그 신원이 확인되면 희생자 유해로 인정할 수 있다.
(1) Where excavated remains fall under any of the following, the Commission may recognize them as remains of a victim if their identity is confirmed through identification under Article 27-2 (5) of the Act:
1. 희생자 유해 매장에 관한 제보(신고ㆍ증언 등을 포함한다)가 접수된 지역으로서 희생자 유해가 매장되었을 가능성이 높은 지역에서 발굴된 경우
1. Where they were excavated in an area where reports (including notifications and testimony) on the burial of victims' remains were received and where there is a high likelihood that victims' remains are buried;
2. 5ㆍ18민주화운동 관련 조사 및 연구를 통하여 희생자 유해가 매장되었을 가능성이 높은 지역에서 발굴된 경우
2. Where they were excavated in an area where there is a high likelihood that victims' remains are buried according to investigation and research related to the May 18 Democratization Movement;
3. 희생자의 것으로 인정할 만한 유품과 함께 발견된 경우
3. Where they were found together with relics recognizable as belonging to a victim; and
4. 그 밖에 희생자 유해로 판단할 수 있는 상당한 근거가 있는 경우
4. Where there are other considerable grounds to judge them to be remains of a victim.
② 위원회는 제1항에 따라 신원확인을 거친 유해 중 신원이 확인되지 않은 유해에 대해서는 심의를 통하여 희생자 유해의 인정 여부를 결정한다.
(2) For remains whose identity has not been confirmed among the remains that underwent identification under paragraph (1), the Commission shall decide through deliberation whether to recognize them as remains of a victim.
