환자안전법 제17조(환자안전사고 보고의 비밀 보장 등)

① 보건복지부장관은 제14조에 따라 환자안전사고를 보고한 자의 의사에 반하여 그 보고자의 정보를 공개할 수 없으며, 보고된 환자안전사고가 발생한 보건의료기관의 경우에는 그 보건의료기관의 장의 의사에 반하여 해당 보건의료기관의 정보를 공개할 수 없다. <개정 2020.1.29>

② 자율보고가 된 환자안전사고에 관한 정보와 제15조 및 제15조의2에 따라 수집한 자료는 보건복지부령으로 정하는 검증을 한 후에는 반드시 개인식별이 가능한 부분을 삭제하여야 한다. 다만, 자율보고를 한 자(환자안전사고를 발생시킨 사람에 한정한다)가 동의한 경우 그 사람의 개인식별정보는 삭제하지 아니할 수 있다. <개정 2020.1.29>

③ 환자안전사고의 정보 수집ㆍ분석 및 주의경보 발령 등의 업무에 종사하거나 종사하였던 사람은 직무상 알게 된 비밀을 다른 사람에게 누설하거나 직무 외의 목적으로 사용하여서는 아니 된다.

④ 보건의료기관의 장은 해당 보건의료기관에 속한 제14조에 따라 환자안전사고를 보고한 자에게 그 보고를 이유로 해고, 전보나 그 밖에 신분이나 처우와 관련하여 불리한 조치를 할 수 없다. <개정 2020.1.29>
