환경오염시설의 통합관리에 관한 법률 제16조(배출부과금의 감면 등)
Act on Integrated Management of Environmental Pollution Facilities, Article 16 (Reduction and Exemption of Emission Charges, etc.)
① 제15조제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 자에게는 대통령령으로 정하는 바에 따라 배출부과금을 감면할 수 있다. 다만, 제6호에 따른 사업자에 대한 배출부과금의 감면은 해당 법률에 따라 부담한 처리비용의 금액 이내로 한다. <개정 2017.1.17, 2019.4.2, 2026.6.9>
(1) Notwithstanding Article 15 (1), emission charges may be reduced or exempted, as prescribed by Presidential Decree, for any of the following. However, the reduction or exemption of emission charges for a business operator under subparagraph 6 shall be within the amount of treatment costs borne under the relevant statute:
1. 「대기환경보전법」 제35조의2제1항 각 호에 해당하는 자
1. A person falling under each subparagraph of Article 35-2 (1) of the Clean Air Conservation Act;
2. 「대기환경보전법」 제35조의2제2항제1호에 해당하는 자
2. A person falling under Article 35-2 (2) 1 of the Clean Air Conservation Act;
3. 「물환경보전법」 제12조제3항에 따른 방류수 수질기준 이하로 수질오염물질을 배출하는 사업자
3. A business operator that discharges water pollutants at or below the effluent water quality standards under Article 12 (3) of the Water Environment Conservation Act;
4. 대통령령으로 정하는 양 이하의 수질오염물질을 배출하는 사업자
4. A business operator that discharges water pollutants at or below the amount prescribed by Presidential Decree;
5. 「대기관리권역의 대기환경개선에 관한 특별법」 제17조제4항에 따른 총량관리사업자
5. A business operator subject to total quantity management under Article 17 (4) of the Special Act on Air Quality Improvement in Air Management Areas;
6. 다른 법률에 따라 대기오염물질 또는 수질오염물질의 처리비용을 부담하는 사업자
6. A business operator that bears the costs of treating air pollutants or water pollutants under other statutes.
② 배출부과금으로 징수할 금액이 3천원 미만인 경우에는 이를 징수하지 아니한다. <신설 2026.6.9>
(2) Where the amount to be collected as an emission charge is less than 3,000 won, it shall not be collected.
