환경기술 및 환경산업 지원법 시행령 제19조의5(신기술인증이나 기술검증의 취소절차)

① 기후에너지환경부장관은 법 제7조의4에 따라 신기술인증이나 기술검증을 취소하려는 경우에는 미리 당사자에게 취소하려는 사유를 구체적으로 제시하여 취소사실의 예고통보를 하여야 한다. <개정 2025.10.1>

② 제1항에 따라 취소사실의 예고통보를 받은 자는 예고통보를 받은 날부터 30일 내에 소명자료를 제출할 수 있다.

③ 기후에너지환경부장관은 제2항에 따라 제출받은 소명자료에 대하여 조사(필요한 경우 현장조사를 포함한다)ㆍ검토한 후 신기술인증이나 기술검증의 취소 여부를 결정하여야 한다. 이 경우 제1항에 따라 취소사실의 예고통보를 받은 자가 제2항에 따른 소명자료를 제출하지 아니한 경우에는 취소의 원인이 되는 사실을 인정한 것으로 본다. <개정 2025.10.1>

④ 기후에너지환경부장관은 신기술인증이나 기술검증을 취소한 경우에는 지체 없이 당사자 및 이해관계인에게 통보하여야 하며, 기후에너지환경부의 인터넷 홈페이지에 게시하여야 한다. <개정 2025.10.1>
