형사소송법 제350조(상소의 포기등과 법정대리인의 동의)

법정대리인이 있는 피고인이 상소의 포기 또는 취하를 함에는 법정대리인의 동의를 얻어야 한다. 단, 법정대리인의 사망 기타 사유로 인하여 그 동의를 얻을 수 없는 때에는 예외로 한다.
