형법 제23조(자구행위)

① 법률에서 정한 절차에 따라서는 청구권을 보전(保全)할 수 없는 경우에 그 청구권의 실행이 불가능해지거나 현저히 곤란해지는 상황을 피하기 위하여 한 행위는 상당한 이유가 있는 때에는 벌하지 아니한다.

② 제1항의 행위가 그 정도를 초과한 경우에는 정황에 따라 그 형을 감경하거나 면제할 수 있다.
