헌법재판소법 제78조(전자적 송달 등)

① 헌법재판소는 당사자나 관계인에게 전자정보처리조직과 그와 연계된 정보통신망을 이용하여 결정서나 이 법에 따른 각종 서류를 송달할 수 있다. 다만, 당사자나 관계인이 동의하지 아니하는 경우에는 그러하지 아니하다.

② 헌법재판소는 당사자나 관계인에게 송달하여야 할 결정서 등의 서류를 전자정보처리조직에 입력하여 등재한 다음 그 등재 사실을 헌법재판소규칙으로 정하는 바에 따라 전자적 방식으로 알려야 한다.

③ 제1항에 따른 전자정보처리조직을 이용한 서류 송달은 서면으로 한 것과 같은 효력을 가진다.

④ 제2항의 경우 송달받을 자가 등재된 전자문서를 헌법재판소규칙으로 정하는 바에 따라 확인한 때에 송달된 것으로 본다. 다만, 그 등재 사실을 통지한 날부터 1주 이내에 확인하지 아니하였을 때에는 등재 사실을 통지한 날부터 1주가 지난 날에 송달된 것으로 본다. <개정 2022.2.3>

⑤ 제1항에도 불구하고 전자정보처리조직의 장애로 인하여 전자적 송달이 불가능하거나 그 밖에 헌법재판소규칙으로 정하는 사유가 있는 경우에는 「민사소송법」에 따라 송달할 수 있다.
