헌법재판소법 제53조(결정의 내용)

① 탄핵심판 청구가 이유 있는 경우에는 헌법재판소는 피청구인을 해당 공직에서 파면하는 결정을 선고한다.

② 피청구인이 결정 선고 전에 해당 공직에서 파면되었을 때에는 헌법재판소는 심판청구를 기각하여야 한다.
