헌법재판소법 제12조의2(헌법재판소장의 권한대행)

① 헌법재판소장이 일시적인 사고로 인하여 직무를 수행할 수 없을 때에는 재판관 중 임명일자 순으로 그 권한을 대행한다. 다만, 임명일자가 같을 때에는 연장자 순으로 대행한다.

② 헌법재판소장이 궐위(闕位)되거나 1개월 이상 사고로 인하여 직무를 수행할 수 없을 때에는 재판관 중 재판관회의에서 선출된 사람이 그 권한을 대행한다. 다만, 그 권한대행자가 선출될 때까지는 제1항에 해당하는 사람이 권한을 대행한다.

③ 제2항 단서의 권한대행자는 제2항의 사유가 생긴 날부터 7일 이내에 제2항 본문의 권한대행자를 선출하기 위한 재판관회의를 소집하여야 한다.

④ 제2항 본문의 권한대행자는 재판관 전원의 3분의 2를 초과하는 인원의 출석과 출석인원 과반수의 찬성으로 선출한다. 다만, 1차 투표결과 피선자(被選者)가 없을 때에는 최고득표자와 차점자에 대하여 결선투표를 하여 그 중 다수득표자를 피선자로 하되, 다수득표자가 2명 이상일 때에는 연장자를 피선자로 한다.
