해운법 제46조(대항조치 등)

①정부는 해운업자가 해상운송과 관련한 외국의 정부기관이나 법인 또는 단체로부터 호혜평등의 원칙에 반하는 다음 각 호의 어느 하나에 해당하는 불이익을 받은 경우에는 그 국가의 선박운항사업자나 그 선박운항사업자의 선박 또는 그 선박운항사업자가 사실상 지배하는 국내 선박운항사업자나 그 국내 선박운항사업자의 선박에 대하여 그에 상응하는 대항조치를 할 수 있다. <개정 2012.12.18>

②정부는 외국의 선박운항사업자가 대한민국의 해운발전을 해치는 행위를 하거나 교역항로의 질서를 어지럽게 한다고 인정되면 그 선박운항사업자 또는 그 선박운항사업자가 소유하거나 운항하는 선박에 대하여 입항규제 등의 조치를 할 수 있다.

③ 제1항에 따른 선박운항사업자가 사실상 지배하는 국내 선박운항사업자의 기준 등에 필요한 사항은 대통령령으로 정한다. <신설 2012.12.18>
