해운법 제21조(운항관리규정의 작성ㆍ심사 및 준수)

①내항여객운송사업자는 여객선등의 안전을 확보하기 위하여 해양수산부령으로 정하는 바에 따라 운항관리규정(運航管理規程)을 작성하여 해양수산부장관에게 제출하여야 한다. 운항관리규정을 변경하고자 하거나 운항여건의 변경 등 해양수산부령으로 정하는 사항이 변경되는 경우에도 또한 같다. <개정 2008.2.29, 2012.6.1, 2013.3.23, 2015.1.6>

②해양수산부장관은 제1항에 따라 운항관리규정을 제출받은 때에는 여객선운항관리규정심사위원회를 구성하여 그 운항관리규정에 대하여 심사를 하여야 하며, 여객선등의 안전을 확보하기 위하여 운항관리규정을 변경할 필요가 있다고 인정되면 그 이유와 변경요지를 명시하여 해당 내항여객운송사업자에게 운항관리규정을 변경할 것을 요구할 수 있다. 이 경우 내항여객운송사업자는 변경 요구받은 사항을 운항관리규정에 반영하여야 한다. <개정 2008.2.29, 2012.6.1, 2013.3.23, 2015.1.6>

③ 내항여객운송사업자는 제1항 및 제2항에 따라 정해진 운항관리규정을 준수하여야 한다. <신설 2015.1.6>

④ 해양수산부장관은 내항여객운송사업자가 운항관리규정을 계속적으로 준수하고 있는지 여부를 정기 또는 수시로 점검하여야 한다. <신설 2015.1.6>

⑤ 해양수산부장관은 내항여객선의 안전운항에 위험을 초래할 수 있는 사항이 있는 경우 출항 정지, 시정 명령 등을 할 수 있다. <신설 2015.1.6>

⑥ 제2항에 따른 여객선운항관리규정심사위원회의 구성ㆍ운영 등에 필요한 사항은 대통령령으로 정하며, 제1항부터 제5항까지의 규정에 따른 심사ㆍ점검 등에 필요한 사항은 해양수산부령으로 정한다. <신설 2015.1.6>
