해양생태계의 보전 및 관리에 관한 법률 시행령 제28조(해양생태계보전부담금의 정산)

①해양수산부장관은 해양생태계보전부담금의 부과대상 사업의 준공검사ㆍ신고 등(이하 "준공검사등"이라 한다)을 받은 후 해당 구역 또는 단지의 해양생태계 훼손면적이 변경됨에 따라 당초 납부한 해양생태계보전부담금과 차이가 발생하는 경우에는 해양생태계보전부담금을 정산하여 부과하거나 환급해야 한다. <개정 2008.2.29, 2013.3.23, 2023.4.18>

②제1항에 따라 해양생태계보전부담금을 환급받으려는 자는 준공검사등을 받은 후 90일 이내에 해양수산부령으로 정하는 서류를 갖추어 해양수산부장관에게 신청해야 한다. <개정 2008.2.29, 2013.3.23, 2023.4.18>
