해양과학조사법 제20조의2(외국 관할해역 등에서의 해양과학조사)

① 대한민국 국민이 「해양법에 관한 국제연합협약」에 따른 외국의 영해, 외국의 배타적 경제수역 및 외국의 대륙붕(이하 "외국 관할해역"이라 한다)에서 해양과학조사를 하려는 경우에는 대통령령으로 정하는 바에 따라 외국 관할해역에서의 해양과학조사에 관한 계획서(이하 "외국해역 조사계획서"라 한다)를 작성하여 해양수산부장관에게 해양과학조사 실시 예정일 7개월 전까지 제출하여야 하고, 해양수산부장관은 해양과학조사 실시 예정일 6개월 전까지 그 외국해역 조사계획서가 해당 국가에 제출될 수 있도록 조치하여야 한다. 다만, 해당 국가의 법령에서 외국해역 조사계획서의 작성에 관하여 달리 정한 경우에는 해당 국가의 관련 법령에 따라 외국해역 조사계획서를 작성하여야 한다.

② 대한민국 국민이 「해양법에 관한 국제연합협약」에 따른 공해 또는 심해저에서 해양과학조사를 하려는 경우에는 공해 또는 심해저에서의 해양과학조사에 관한 계획서(이하 "공해 등 조사계획서"라 한다)를 해양과학조사 실시 예정일 1개월 전까지 해양수산부장관에게 제출하여야 한다. 다만, 다른 법률에서 정하는 바에 따라 신고를 하거나 허가를 받아 해양과학조사를 실시하는 경우에는 그러하지 아니하다.

③ 대한민국 국민은 제1항 또는 제2항에 따라 외국 관할해역, 공해 또는 심해저에서 해양과학조사를 하는 경우에는 「해양법에 관한 국제연합협약」 및 해당 국가의 관련 법령에 따른 방법으로 해양과학조사를 실시하여야 한다.

④ 해양수산부장관은 제1항 또는 제2항에 따라 제출된 외국해역 조사계획서 및 공해 등 조사계획서에 대하여 필요하다고 인정할 때에는 그 조사계획서의 보완을 권고할 수 있다.

⑤ 제1항 및 제2항에 따른 외국해역 조사계획서 및 공해 등 조사계획서의 제출 절차 등에 관하여 필요한 사항은 대통령령으로 정한다.
