항만지역등 대기질 개선에 관한 특별법 시행령 제12조(권한 등의 위임 및 위탁)
Enforcement Decree of the Special Act on Improving Air Quality in Port Areas, Article 12 (Delegation and Entrustment of Authority, etc.)
① 해양수산부장관은 법 제21조제1항에 따라 다음 각 호의 권한을 지방해양수산청장에게 위임한다. <개정 2023.6.7>
(1) Pursuant to Article 21 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority to the heads of Regional Oceans and Fisheries Offices:
1. 법 제11조제2항에 따른 저속운항에 필요한 지원(「항만공사법」 제4조제4항에 따른 항만공사 관할 무역항에 입항ㆍ출항하는 선박의 저속운항에 필요한 지원은 제외한다)
1. Support necessary for slow-speed navigation under Article 11 (2) of the Act (excluding support necessary for slow-speed navigation of vessels entering or leaving trading ports under the jurisdiction of a port authority under Article 4 (4) of the Port Authority Act);
2. 법 제13조제2항에 따른 비산먼지 발생억제를 위한 시설의 설치나 조치의 이행 또는 개선 명령
2. Orders to install facilities or take measures to suppress fugitive dust, or to implement or improve them, under Article 13 (2) of the Act;
2의2. 법 제14조제2항에 따른 하역장비 운영현황 파악에 필요한 자료의 제출 요구
2-2. Requests for submission of materials necessary for ascertaining the operating status of cargo-handling equipment under Article 14 (2) of the Act;
3. 법 제16조제1항에 따른 자동차의 출입제한 조치 및 같은 조 제2항에 따른 필요한 자료의 제출 요구
3. Measures to restrict the entry of automobiles under Article 16 (1) of the Act and requests for submission of necessary materials under paragraph (2) of the same Article;
4. 법 제19조제1항에 따른 선박 또는 항만사업자의 사업장 출입검사
4. Entry inspections of vessels or places of business of port operators under Article 19 (1) of the Act;
5. 법 제20조에 따른 선박의 정선ㆍ검색ㆍ나포ㆍ입출항금지 등 명령 또는 조치
5. Orders or measures such as stopping, searching, seizing, and prohibiting entry into or departure from port of vessels under Article 20 of the Act;
6. 법 제25조에 따른 과태료의 부과ㆍ징수
6. Imposition and collection of administrative fines under Article 25 of the Act.
② 해양경찰청장은 법 제21조제1항에 따라 다음 각 호의 권한을 해양경찰서장에게 위임한다. <개정 2023.6.7>
(2) Pursuant to Article 21 (1) of the Act, the Commissioner General of the Korea Coast Guard delegates the following authority to the heads of Coast Guard Stations:
1. 법 제19조제1항에 따른 선박 또는 항만사업자의 사업장 출입검사
1. Entry inspections of vessels or places of business of port operators under Article 19 (1) of the Act;
2. 법 제20조에 따른 선박의 정선ㆍ검색ㆍ나포ㆍ입출항금지 등의 명령 또는 조치
2. Orders or measures such as stopping, searching, seizing, and prohibiting entry into or departure from port of vessels under Article 20 of the Act;
3. 법 제25조에 따른 과태료의 부과ㆍ징수(법 제24조제1호부터 제4호까지의 경우로 한정한다)
3. Imposition and collection of administrative fines under Article 25 of the Act (limited to the cases in Article 24 subparagraphs 1 through 4 of the Act).
③ 기후에너지환경부장관과 해양수산부장관은 법 제21조제3항에 따라 법 제9조제1항에 따른 측정망 설치 및 대기질의 상시 측정에 관한 업무를 「한국환경공단법」에 따른 한국환경공단에 위탁한다. <개정 2025.10.1>
(3) Pursuant to Article 21 (3) of the Act, the Minister of Climate, Energy and Environment and the Minister of Oceans and Fisheries entrust the work of establishing the monitoring network under Article 9 (1) of the Act and continuously measuring air quality to the Korea Environment Corporation under the Korea Environment Corporation Act.
④ 해양수산부장관은 법 제21조제3항에 따라 법 제9조제3항 및 이 영 제5조제4항에 따른 측정결과 및 조사결과의 활용에 관한 업무를 「해양환경관리법」 제96조제1항에 따른 해양환경공단에 위탁한다.
(4) Pursuant to Article 21 (3) of the Act, the Minister of Oceans and Fisheries entrusts the work of utilizing the measurement results and survey results under Article 9 (3) of the Act and Article 5 (4) of this Decree to the Korea Marine Environment Management Corporation under Article 96 (1) of the Marine Environment Management Act.
⑤ 해양수산부장관은 법 제21조제3항에 따라 「항만공사법」 제4조제4항에 따른 항만공사 관할 무역항에 입항ㆍ출항하는 선박의 법 제11조제2항에 따른 저속운항에 필요한 지원 업무를 「항만공사법」에 따른 항만공사에 위탁한다.
(5) Pursuant to Article 21 (3) of the Act, the Minister of Oceans and Fisheries entrusts the work of supporting slow-speed navigation under Article 11 (2) of the Act for vessels entering or leaving trading ports under the jurisdiction of a port authority under Article 4 (4) of the Port Authority Act to the port authority under the Port Authority Act.
